Tudaloo Pty Ltd (ABN 79 672 666 705) ("Tudaloo", "we", "us", "our") operates the website tudaloo.com.au. These Terms of Service ("Terms") govern your access to and use of our website, including any content, products, and services made available through it.

2. About Our Products

Tudaloo sells bidets, smart toilets, and related accessories for the Australian market. All plumbing products sold by Tudaloo are intended for use in Australia and are supplied in accordance with applicable Australian standards.

We make every effort to display product colours, dimensions, and features accurately on our website. However, actual product appearance may vary slightly due to screen settings, photography, and manufacturing tolerances.

3. Eligibility

You must be at least 18 years of age to make a purchase through our website. By placing an order, you confirm that you have the legal capacity to enter into a binding agreement.

4. Orders and Pricing

All prices displayed on our website are in Australian dollars (AUD) and include GST unless otherwise stated. We reserve the right to change pricing at any time, but price changes will not affect orders that have already been confirmed.

An order is not accepted until we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion — for example, if a product is unavailable, if there is a pricing error, or if we suspect fraudulent activity. If we cancel an order after payment has been taken, we will issue a full refund.

5. Payment

We accept payment via the methods displayed at checkout. All payment transactions are processed securely through our third-party payment provider. Tudaloo does not store your full credit card details.

For preorder products, a deposit may be required at the time of ordering, with the balance due before dispatch. Preorder purchases are subject to our Halo Preorder Terms & Conditions.

6. Shipping and Delivery

We aim to dispatch orders within the timeframes stated on our website, but delivery dates are estimates only and not guaranteed. We are not liable for delays caused by shipping carriers, customs, weather events, or other circumstances beyond our reasonable control.

Risk in the products passes to you on delivery. If a product is damaged or lost in transit, please contact us at support@tudaloo.com.au as soon as possible so we can arrange a resolution.

7. Installation Requirements

All Tudaloo bidet and smart toilet products that connect to a water supply must be installed by a licensed plumber. This is a requirement under Australian plumbing regulations and ensures your installation complies with the Plumbing Code of Australia, including provisions to prevent cross-contamination of water supplies.

Tudaloo is not liable for any damage, water damage, warranty claims, or regulatory non-compliance arising from installation by an unlicensed person. Installing a plumbing product without a licensed plumber may also affect your home insurance coverage.

8. Returns, Refunds, and Consumer Guarantees

Your rights under the Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits, excludes, or modifies your rights under the Australian Consumer Law or any other statutory rights that cannot be lawfully excluded.

9. Warranties and Disclaimers

Subject to your rights under the Australian Consumer Law (which are not affected by these Terms):

  • Our website content is provided for general information purposes. While we take reasonable care, we do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We do not warrant that any information, recommendations, or content on our website (including blog posts, installation guides, and product descriptions) is complete, accurate, or up-to-date in all respects.
  • Product images and descriptions are indicative only. Minor variations in colour, finish, or specifications may occur.

To the extent permitted by law, all other warranties, representations, and conditions — whether express or implied — are excluded.

10. Limitation of Liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

  • Tudaloo's total liability to you for any claim arising under or in connection with these Terms is limited to the amount you paid for the relevant product or service.
  • Tudaloo is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, arising from your use of the website or our products.

This limitation of liability does not apply to liability that cannot be lawfully limited or excluded, including liability under the consumer guarantee provisions of the Australian Consumer Law.

11. Intellectual Property

All content on the Tudaloo website — including text, graphics, logos, images, product photography, videos, and page layout — is owned by or licensed to Tudaloo and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or republish any content from our website without our prior written consent, except for personal, non-commercial use such as printing a product page for reference.

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of the website by, any third party. You must not:

Nothing in this clause limits your right to bring proceedings in any court or tribunal with jurisdiction under the Australian Consumer Law.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
